Family trust in Taiwan or in Singapore: what does it cost, is there a minimum, and which tax actually decides it?
The cost that decides it is the tax on the day the trust is funded, not the trustee's fee, and it is the same whether the trustee sits in Taipei or Singapore. Estate and Gift Tax Act article 5-1 treats a trust for anyone other than the settlor as a gift when the deed is signed. On the Ministry of Finance's 2026 table of 27 November 2025, the annual exemption is NT$2.44m and the 20 per cent rate starts above NT$56.21m, so NT$100m in cash settled on the children costs NT$15,296,000 in gift tax. Yuanta Bank's July 2024 fee schedule and the trust association's table both price a bespoke trust case by case. Taiwan suits Taiwan-situs property and elder-care money; Singapore adds trustee continuity, a neutral forum and Trustees Act 1967 section 90 for offshore movables, not a smaller Taiwanese tax bill.

A gift tax bill arrives the day a father funds a trust for his children, whether the trustee sits in Taipei or Singapore
Trust Act article 1 defines a trust as a transfer of property to a trustee who manages it for a beneficiary. Estate and Gift Tax Act article 5-1 deems a settlor whose deed names someone else as beneficiary to have given that person the right to the trust benefit, and article 24-1 dates the gift to the day the deed is signed; naming himself and switching later, or adding property later, is a gift at that moment. A trust for the settlor himself runs the other way: article 5-2 charges no gift tax on the transfer to the trustee, and article 3-2 taxes the unreceived benefit in his estate.
Worked, for scale. Method: a father habitually resident in Taiwan settles NT$100,000,000 in cash on his two children in 2026, all of the benefit to them. Article 10-2, item 1 values the gift at the cash settled. The Ministry of Finance's 2026 table, prepared 27 November 2025, allows NT$2.44m a year and taxes 10 per cent to NT$28.11m, 15 per cent to NT$56.21m and 20 per cent above. The gift tax is NT$15,296,000, payable by the settlor. At 0.5 per cent a year, the top of the standard elder-care range the trust association lists, a trustee would need about 30 years of fees to cost as much.
Three things do not move that number. Article 3 taxes a habitually resident national's gifts of property inside or outside Taiwan, and nothing in article 5-1 turns on where the trustee sits. Article 15 still deems gifts to the spouse or heirs in the two years before death part of the estate. And the classic discount, keeping the principal and giving away only the income, discounted under article 10-2 at the postal one-year deposit rate, was closed by Ministry ruling Tai-Cai-Shui No. 10000076610 of 6 May 2011 where the dividends were known or controlled when the deed was signed: that income stays the settlor's, and gift tax follows on payout.
No Taiwanese bank prices a bespoke family trust in public; the published fees belong to elder-care trusts
This is the gap the search results fill with undated numbers. Trust Enterprise Act article 19 requires every trust contract to state the trustee's remuneration (standard, type, method, timing), so the fee is a term of each deed, not a regulated tariff. Yuanta Commercial Bank's fee schedule, July 2024 edition, says it plainly: for customised trusts the signing fee, the management fee and other charges are each agreed contract by contract. The trust association's comparison table for elder-care trusts, undated when read on 16 October 2026 and carrying its own warning that it may contain errors, says the same of every bespoke contract it lists: priced case by case.
What the table does publish is the standard-contract price of an elder-care trust, and it is modest: signing fees mostly NT$1,000 to NT$5,000, with a few banks charging a percentage of the assets; management at 0.2 to 0.5 per cent a year with a monthly minimum, a few higher, up to 1 per cent. Entry thresholds run from none to NT$1,000,000. The Trust Act sets no minimum at all. Any family-trust minimum or fee quoted on a bank, adviser or blog page is therefore that institution's own offer on the day it was written: useful as a quote, never as a rule.
What the fee buys is legal effect, not tax. Trust Act article 12 bars enforcement against trust property, save for rights that predate the trust. Article 4 makes that bind third parties only once registrable property is registered as trust property, securities are marked, or the issuer of shares is notified. Article 6 lets the settlor's creditors ask a court to set aside a trust that harms them, presumed if he is made bankrupt within six months; article 7 allows one year from knowledge, ten from the act. Trust Enterprise Act article 33 reserves trust business taken from the public to licensed trust enterprises.
Taiwan has agreed in principle to a 100-year family trust; the tax ruling that makes it work was still unpublished on 16 October 2026
On 5 May 2026 the Financial Supervisory Commission announced a cross-ministry consensus, with the finance and justice ministries, on the continuous-beneficiary trust, in which later generations succeed as beneficiaries, for terms of up to 100 years. The Ministry of Justice confirmed in 2023 that such a deed works under the existing Trust Act if the term is fixed and the beneficiaries ascertainable. The consensus: where the deed fixes the term and each succession's conditions, a later beneficiary takes by contract, not by gift or inheritance, so no further gift or estate tax arises. The Ministry of Finance is to issue a ruling.
Two cautions for the heir reading this. The condition: during the term neither the settlor nor the beneficiaries may hold decision power or substantial influence over the trust property or the benefit rights. The price of a single tax charge is that the founder lets go. The timing: we found no such ruling among the Taxation Administration's press releases from late April to 16 October 2026, and the Commission's release says nothing that displaces article 5-1, so the gift at setup remains. On duration, the gap between Taiwan and Singapore has closed on paper; on the Taiwan side it still waits for one ruling.
A Singapore trust changes who holds the assets and which court reads the deed; Taiwan's tax and Taiwanese land stay where they were
What Singapore adds, from the text. Trustees Act 1967 section 90, read on Singapore Statutes Online as at 16 October 2026, provides that no rule of inheritance or succession affects the validity of a lifetime trust, or a transfer of movables onto one, by a settlor with capacity, provided he was neither a Singapore citizen nor Singapore-domiciled, the trust is expressed to be governed by Singapore law and the trustees are resident in Singapore. The perpetuity period is 100 years. Trust Companies Act 2005 section 3 requires a licence to carry on trust business; MAS's directory listed 67 licensed trust companies on 16 October 2026. Neither publishes a fee scale.
What it does not change. The setup gift and the estate remain Taiwanese questions under articles 1, 3 and 5-1. Shares in a low-tax holding company stay inside the individual CFC rule of Income Basic Tax Act article 12-1, in force since 1 January 2023; Singapore sits in the territorial-or-remittance category of the low-tax reference list the Ministry of Finance updated on 21 December 2023. On 4 February 2025 the Ministry reminded trustees of such shares to file Taiwan trust-income returns each January, offshore ones through a Taiwan agent. The page on how the National Taxation Bureau finds overseas income covers the exchange channel open since 13 February 2026.
Nor does it reach into Taiwan. Section 90 binds a Singapore court, not a Taipei one; Taiwanese land stays under Taiwanese law and the land registry, and a testamentary trust is taxed at death under article 3-2 and, as the page on whether 特留分 can be avoided sets out, reached by abatement. The honest division: Taiwan-situs property and elder-care money sit well in a Taiwanese trust, at published prices; offshore movables go to Singapore where continuity and a neutral forum matter. The tax is the same either way, which is why the deed is worth reading together while everyone is alive.
